In the context of the project implementation, the project site and the real estate located at a certain distance from it, if it is written in the contract that no one else can use the project site for the purpose of a specific work or build any construction or do any other work on that land, or if such real estate is not allowed to be used for the purpose of that work or such a house If the person who has obtained a permit to prohibit any construction or any other work on the land submits an application to the Government of Nepal and if the application is deemed appropriate, the Government of Nepal shall prohibit the use of such real estate or any construction or any work in accordance with the prevailing law. can do However, the person receiving the permit will have to bear the compensation for the loss caused to the concerned person due to such prohibition.
(2) In order to determine the compensation to be given in accordance with sub-section (1) or sub-section (2) of section 26, there will be a compensation determination committee as specified to represent the local consumers and the said committee will determine the compensation after evaluating the actual loss suffered by the concerned person.
(3) A person who is not satisfied with the amount of compensation determined according to sub-section (2) may file a complaint with the Government of Nepal within thirty-five days from the date of receiving information about that decision.
(4) The decision on the complaint filed under sub-section (3) shall be completed within three months and the decision made by the Government of Nepal regarding the said complaint shall be final.
